By purchasing, using, or permitting the use of any product sold by Saddlery Inc., UHORSE Saddle & Leather Superstore, Hilason Saddles, or any of their parent, sister, or subsidiary entities (collectively referred to as the “Company”), you (“the User” or “Purchaser”) acknowledge and agree to the following terms:
Horseback riding and all equestrian-related activities are inherently dangerous and carry significant risks of injury, property damage, or even death. These risks exist regardless of the rider’s skill level or the condition and quality of the equipment used. By choosing to engage in such activities and by using our products, you voluntarily assume all risks—both known and unknown—associated with their use.
To the fullest extent permitted by law, you agree to release, discharge, indemnify, and hold harmless the Company—including its owners, officers, employees, contractors, agents, and affiliates—from any and all claims, demands, causes of action, liabilities, losses, damages, or expenses (including reasonable attorney fees) arising from or related to the purchase, use, misuse, defect, or failure of any product sold by the Company.
This release applies to all legal theories, including but not limited to negligence, strict liability, and breach of warranty, even if caused by the Company’s own negligence.
All products are sold “as is”, with no express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose. It is the Purchaser’s responsibility to inspect all equipment prior to use, ensure it is properly maintained, and use it solely as intended and with appropriate care.
The Company does not guarantee that any product will prevent injury or function safely in all conditions or scenarios.
If you do not agree to the terms stated in this Disclaimer and Release, you must not use the product and should return it unused and in new condition within the return period for a full refund, subject to the Company’s return policy.
This agreement is governed by the laws of the State of Texas, without regard to conflict of law principles. Any legal actions or disputes arising out of or related to this agreement or the use of any product sold by the Company shall be brought exclusively in the state or federal courts located in Fort Bend County, Texas, and you hereby consent to the personal jurisdiction of such courts.
By completing your purchase, you confirm that you have read, understood, and voluntarily accepted this Disclaimer and Release of Liability in its entirety.
